Prenuptial Agreements
Unfortunately, a significant percentage of marriages now end in divorce and therefore it is inevitable that people, particularly those who have been married before, will want to agree what should happen in the event of a divorce.
Historically Prenuptial Agreements have been unenforceable in this country.
However, recent case law is such that the likelihood is such agreements will be upheld in the Courts in the future.
WHAT DOES A PRENUPTIAL AGREEMENT COVER?
A Prenuptial Agreement can provide certainty and a way of protecting property not derived from the marriage such as pre-marital assets, gifts from third parties and inheritances. A Prenuptial Agreement can also be useful where there is unequal wealth or assets between the parties prior to marriage.
